Terms and Conditions
The terms that apply to orders placed with Foods Market through this website.
These terms govern your use of this website and the sale of goods by Foods Market. Where we have agreed separate written trading terms with you, those take precedence to the extent the two differ.
Orders and acceptance
An order placed on this website is an offer to buy. It becomes a contract when we confirm it, not when you submit it. We may decline an order — for example where stock has run out, where a price was listed in error, or where we cannot deliver to the address given.
Prices and tax
Prices are shown in the currency stated at checkout and exclude VAT unless the page says otherwise. VAT is calculated and shown separately before you confirm the order; most basic foodstuffs are zero-rated. Prices can change without notice, but the price confirmed on your order is the price you pay for that order.
Weights and pack sizes
Loose produce is sold by weight and packed to the nearest sensible unit, so an item ordered as one kilogram may arrive a little over or under. Where the difference is material we adjust the invoice rather than the basket. Pack sizes on manufactured goods are as printed by the manufacturer.
Substitutions
We do not substitute an item for something else without asking you first. If a line is unavailable when we pick your order we will call you to offer an alternative, remove it from the order, or hold the delivery.
Payment
Orders are paid online at checkout, in cash to the driver on delivery, or at the till on collection. Approved business account customers are invoiced on the terms agreed with them. Goods remain our property until they have been paid for in full.
Delivery and collection
Delivery windows given at checkout are estimates made in good faith and depend on the run and on traffic. Risk in the goods passes to you on delivery, or on collection if you collect.
If nobody is available to receive a delivery, the driver will call you; where we cannot deliver, the order returns to the store and fresh items are repacked for a later run. Collection orders are held for 24 hours, after which perishable items are returned to sale.
Freshness, returns and refunds
Check your order when it arrives. Anything you are not happy with can be handed straight back to the driver and it will be credited.
Fresh produce that is not in good condition on the day it reaches you will be replaced or refunded — tell us the same day. Unopened dry goods may be returned within seven days with proof of purchase. Opened packs and perishable goods cannot be returned once accepted, except where the goods were not of satisfactory quality, were not as described, or were supplied in error. Nothing in these terms limits your statutory rights as a consumer.
Allergens and food information
Allergen and ingredient information published on this site is taken from the manufacturer's packaging and is provided for guidance. Manufacturers change recipes and packaging, and a website can be a batch behind. If you are shopping for an allergy, always read the label on the product when it reaches you, and treat the pack as authoritative over this site.
Storage after delivery
Once an order has been handed over, keeping it at the right temperature is down to you. Chilled and fresh items should go into a fridge promptly. We cannot be responsible for food left standing after delivery.
Use of this website
You may browse and use this website for lawful purposes. You may not attempt to gain unauthorised access to any part of it, submit automated or abusive form submissions, or reuse its content commercially without written permission. You are responsible for keeping your account password confidential.
Liability
Our liability in connection with any order is limited to the value of that order, except where liability cannot lawfully be limited, including liability for death or personal injury caused by our negligence and liability for supplying food that is unfit to eat.
Governing law
These terms are governed by the laws of Zimbabwe. They may be updated from time to time; the version published on this page when you place an order is the version that applies to that order.
